Your right to change your mind

If you are a consumer in the European Union, you have the right to withdraw from your purchase within 14 days without giving any reason.

The same right applies to a sole trader buying from us under a contract that is directly related to their business but is clearly not of a professional character for them (Article 7aa of the Polish Consumer Rights Act). Wherever this page says "consumer", it also covers such a buyer.

The 14-day period starts on the day you (or someone you nominate) take physical possession of the goods.

To withdraw, tell us clearly before the 14 days are up. You can:

• email us at myartkingcompany@gmail.com, or
• use the withdrawal form at the bottom of this page (using it is optional).

Sending your notice before the deadline expires is enough — it does not need to reach us within the 14 days.

⚠️ Important: personalised items cannot be returned

The 14-day right of withdrawal does not apply to items made to your specification or clearly personalised — for example, a magnet engraved with a name, a custom design, or a piece made to your individual requirements.

This is set out in Article 38(3) of the Polish Consumer Rights Act. Once we have started making a personalised item for you, we cannot resell it to anyone else.

This does not affect your rights if the item arrives damaged or faulty — see "If something is wrong with your order" below.

Products that cannot be returned are clearly marked as personalised in the product description. If a product is not marked, the standard 14-day right of withdrawal applies.

Choosing a colour from the list on a product page is not personalisation and does not affect your right of withdrawal. Personalisation means content or a design that comes from you — a name, a date, your own wording, artwork or a logo. Picking one of our ready-made colours is none of these.

Effects of withdrawal

If you withdraw, the contract is treated as never concluded. Two obligations then arise: you send the item back, and we refund you. Both are described below.

Sending the item back

Return the item to us within 14 days of telling us you are withdrawing.

You pay the cost of return shipping. We do not cover the cost of sending an item back to us when you simply change your mind.

The easiest way is through an InPost Paczkomat locker — the same way your order arrived. You do not need to print anything or queue at a post office.

Use the InPost SzybkieNadania service in the InPost mobile app or at inpost.pl: enter our address below as the recipient, pay for the parcel and drop it into any locker. Keep the sending confirmation until your refund arrives.

Email us at myartkingcompany@gmail.com with your order number and the parcel number, so we know to expect it.

The item must come back in the condition you received it. You may unpack and inspect it as you would in a shop, but if you handle it beyond what is necessary to establish its nature, characteristics and functioning, we may reduce your refund to reflect the loss in value.

Your refund

We refund you within 14 days of receiving your withdrawal notice.

We refund:

• the full price of the item, and
• the delivery cost you actually paid to receive it. If your order qualified for free delivery, there is no delivery charge to refund.

We refund using the same payment method you used to pay, through Stripe. You will not be charged any fee for the refund.

We may hold your refund until we receive the item back, or until you provide proof that you have sent it — whichever comes first.

If something is wrong with your order

Everything above is about changing your mind. If your item arrives damaged, faulty, or not as described, different rules apply and they are more favourable to you.

We are liable for goods that do not conform to the contract for two years from delivery.

In that case:

• We pay for return shipping. Always.
• You can ask us to repair or replace the item.
• If repair or replacement is not possible or reasonable, you can ask for a price reduction or withdraw from the contract and get a full refund.
• This applies to personalised items too. The exclusion above covers changing your mind, not defects.

Handmade means slight variations

Each item is made by hand from natural wood. Small differences in grain, colour and finish between one piece and another are a natural feature of the material, not a defect. We photograph our products honestly, but wood is never identical twice.

Complaints and dispute resolution

If you are not satisfied with how we handle your complaint, you can seek help from:

• your local rzecznik konsumentów (municipal or district consumer ombudsman);
• the Wojewódzki Inspektorat Inspekcji Handlowej — a request for out-of-court resolution of a consumer dispute;
• the permanent consumer arbitration court (stały polubowny sąd konsumencki) attached to the Regional Trade Inspectorate;
• consumer organisations such as Federacja Konsumentów.

The register of bodies authorised to resolve consumer disputes out of court is kept by the President of the Office of Competition and Consumer Protection (UOKiK) and is available at uokik.gov.pl.

Using any of these routes is voluntary and does not affect your right to bring a claim before an ordinary court.

Annex 1 — Information on the right of withdrawal

(Wording follows the model instructions in Annex 1 to the Polish Consumer Rights Act of 30 May 2014.)

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period expires after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. Where your order consists of several items delivered separately, the period runs from the day you acquire physical possession of the last item.

of your decision to withdraw from this contract by an unequivocal statement — for example a letter sent by post or by email.

You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we will reimburse to you all payments received from you, including the costs of delivery — with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us — without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exception

The right of withdrawal does not apply to Products made to your specification or clearly personalised (Article 38(3) of the Polish Consumer Rights Act). Choosing a colour or pattern from the list shown on a product page is not such personalisation.
